Is there any way around Sprint’s automatic plan upgrade with an activated smart phone?

If you’re asking if there is a way to get a free data plan on a smart phone, there isn’t.
If you’ve been with Spirt for a while, I suggest calling them and see what kind of other options or plans might be available to you.

I’m sorry, that is not what I was asking. I want to use this smart phone or another like it but without the plan upgrade from sprint. Some people are using smart phones without having to upgrade but that’s due to a grandfather clause sprint issued to all users who were using smart phones before they switched everyone over to their 79.99 plan. All I want is to use (pay) this phone for texting/calling. I like this phones other (unpaid) features is why I prefer it over a simple messaging phone.

Okay, I think I’m still a little confused. So please answer the following questions, I realize some of these are repeating things you may have already stated and they are a little lengthy, but I want to be sure I totally understand your needs:
1. What phone are you currently using, and who is your cell phone provider for that phone? How long have you had the phone?
2. Do you want to switch to a new phone? If so, what phone do you want to buy, and are there other phones you’re interested in?
3. How many hours of talk time do you want a month, and how many texts per month?
4. Are you willing to consider other cell phone providers such as AT&T or Verizon?
5. What is your budget for a monthly bill, and also how much for a phone?
